TERMS & CONDITIONS WAIVER OF LIABILITY As a participant in this program, you represent that you have no congenital physical or mental health problems that will preclude participation in the services provided by Demo Fitness Studio. Specifically you represent that you have no underlying cardiovascular, neurological, orthopedic or any other illness that will preclude participation in any training program. You assume risk with any/all of the fitness programs specified under this agreement provided by Demo Fitness Studio. You also acknowledge that boot camps, cardiovascular, kick boxing, running, resistance training, timed events, obstacle course,and any other related sports activities are an extreme test of one's mental and physical limits and carry with it potential for damage or loss of property, serious injury and death. You also understand the risks of participating in these types of events/activities, you are healthy enough to participate, and you have a regular medical physician that you can contact regarding any medical problems that you might develop. You expressly waive, release, discharge and agree not to sue (from any liability of death, disability, personal injury, or action of any kind) Demo Fitness Studio, Demo Fitness Studio's assistants/instructors or any other guest acting on behalf of Demo Fitness Studio. It is strongly recommend that you consult with your physician before beginning any exercise program. If you are under 18, pregnant, nursing or have health problems, consult your doctor about specific medical conditions. If you have not been for a physical in the last 12 months, it is strongly advised that you do so prior to participating in any physical activity. MISSED DAYS/ABSENCES You may NOT transfer your missed days to anyone else. You may not pro-rate any monthly fees because of missed days. Payments are due in full no matter how many days you miss or are unable to attend. LATE CHARGES/FEES FOR RETURNED OR INSUFFICIENT FUNDS If Demo Fitness Studio receives a payment more than 5 days after the due date, you will be charged $25.00. If any payment under this agreement is returned, you will be charged $10.00 returned item fee for checks and $25.00 for any credit card payments that are not honored. TRANSFERS/CHANGES Once enlisted in a course/activity, you must complete the entire agreement/course before switching to a different course length. You may NOT transfer your registration of any length to another person. REFUNDS/CANCELLATION There are NO REFUNDS. If you have to cancel this agreement, for any reason (sick, injury, family emergency, work changes, etc.) and are only signed up for one course (month) - you still owe any remaining balance by the last day of the course. If you pay by check or cash, you will still be responsible to either mail, or hand-deliver any remaining balance to Demo Fitness Studio. If you pay by credit card or paypal account, you will automatically be billed. If you are signed up for multiple courses (months) and you have to terminate this contract completely, you will be back billed the difference between the discounted rate and the amount of the courses you actually completed. If you have paid a deposit and are not able to start on the date requested, you may apply that deposit to another course and have up to two courses to use said deposit. If you are unable to attend within that new time frame, you forfeit your deposit. If you choose to make a donation of any amount, you agree that it is to be used by Demo Fitness Studio in whatever way Demo Fitness Studio deems fit for the betterment of the program.
